Case Summary

The Complainant is the owner of the project land and had granted the land for construction to the respondent promoter on the condition that she receives 50% area share out of the total constructed area. The respondent violated the agreement and left the project incomplete.

The complaint is filed as the complainant is not included as the co-promoter of the project and also did not get the aforesaid number of apartments as part of the agreement.

The respondent promoter claims that 80% of the construction is completed and the remaining could not be done due to the disputes with the complainant.

Conclusion by MahaRERA:

The Authority directs both the complainant as well as the respondent to jointly update the information pertaining to the status of the complainant as the co-promoter of the project, bank details, Declaration in Form B, sanctioned layout plans etc.

The details should be updated on or before 22/09/2017 and also submit compliance report before the Authority.

Hence, the complaint is disposed.
