Case Summary

The complainant has filed this complaint praying for possession of the apartment booked in Respondent’s Project.

On 30th October 2017, the matter was heard where, the complainant contended that the agreement for sale was executed on 11th November 2011 and till date has made 80% payment. The remaining payment is to be payable at the time of possession. Therefore, the complainant is complaining about delayed possession and prayed to direct the respondent to handover the possession with Occupation Certificate at the earliest.

During the hearing, the respondent stated that the project is now nearing completion and has been delayed due to reasons beyond his control. He further said that on MahaRERA website he put a revised date of completion as on 31st January 2018. The complainant agreed to the said date of possession.

Conclusion by MahaRERA

For the above aforesaid fact, the authority directs the respondent to handover the possession before the period ending 31st January 2018, Otherwise, he shall be liable to pay interest to the complainant from 1st February 2018 to till the date of possession. The interest shall be at the rate of SBI highest MCLR (prevailing at such time) plus two percent, as prescribed under Rule 18 of the Maharashtra Real Estate Rules, 2017.

Hence, the matter is hereby disposed off.
