Summary Case Summary According to the complainant, He had purchased a flat no.303 at 3rd floor in ‘Glory’ Building at village Vadavali, Kalyan. The consideration amount of Rs.22, 09,320/-, out of which he has paid 20 lacs. The agreement for sale is dated on 22-02-2013, in which the date of possession was June 2016 with a grace period of 6 months. The complainant alleged that the respondent is failed to give possession according to the said date of the agreement. Hence, the complainant is claiming for the interest for the delayed possession. The matter was heard on 10-10-2017, for the whole matter the respondent offers that he is ready to settle the matter amicably and he requested for an adjournment. But, the complainant refuse to take the offer. Conclusion by MahaRERA Authority observed the aforesaid matter, according to them it’s clear that the possession has been delayed. So, as per the Rule18 of Maharashtra Real Estate Rules,2017 the respondent is responsible to pay an interest equal to the SBI highest marginal cost of the lending rate with plus two percent . The respondent shall pay the interest from May 2017 to till the date of possession and he has to pay interest within a period of 30 days or moreover, he shall also submit the compliance report from the date of payment. Hence, the above direction the case is disposed of. |
