Case Summary

The Complainant had purchased an apartment in the respondent’s project known as ‘Universal Infra Developers’ under a registered agreement for sale dated 27th November 2013 .In the agreement, the said date of the possession of the apartment is on or before 30th October 2014, but till the date of possession has not yet been received.

Moreover, the respondent put a revised date of completion as 31st March 2018 on MahaRERA website and therefore, the complainant prayed for earlier possession and compensation paid by them till the possession and the interest on the amount which was paid.

For all the grievances the respondent explained the reasons due to which the completion of the project has got delayed. He also said that he has applied for Occupation certificate which is expected to be in 45 days.

 Therefore, he is ready to give possession to the complainant on or before 30th November 2017, on the complainant paying the balance amount of consideration of the apartment. The respondent also agreed to waive the interest levied by him on the complainant for delayed payment of installment.

                                                         

Conclusion by MahaRERA

According to the MahaRERA, Both the respondent and the complainant mutually agreed to the revised possession date of 30th November 2017.

And, It is directed to the respondent to handover the possession before the period ending November 2017, Otherwise, he shall be liable to pay interest on the entire amount paid by the complainant, from 1st December 2017 till the date of possession. The interest shall be at the rate of SBI highest Marginal Cost Of Lending Rate prevailing at such time plus two percent.

Hence, the matter is hereby disposed off.
