Summary Case Summary In 2009 – Complainant purchased two open developed plots from the respondent. In 2011 – complainant gave the contract for construction of bungalows to the respondent’s sister concern, where respondent is the director. The complainant alleges that the respondent has failed to deliver one of the bungalows and also gave the said bungalow on rent since 2014. The complainant prays for following orders:
The advocate for the respondent argued that the subject matter of the complaint is construction, which does not fall within the jurisdiction of this Authority. Conclusion by MahaRERA As the promoters have handed over the possession of the developed plots to the complainant, their role has been completed. The contract to construct the bungalows between the parties is not a matter of jurisdiction of this Authority. Hence, the complaint is disposed of. |
