Summary Case Summary 28-02-2013: The complainant booked a flat in the respondent’s project and paid around Rs 41 lacs out of the total Rs 53.125 lacs but still the respondent did not register the Agreement. 31-08-2017: The respondent executed the registered Agreement with the complainant in front of two member’s bench of MahaRERA. 7-09-2017: In this hearing, the complainant brought to the notice of the Authority that respondent has changed the date of delivery of the project to December 2022, which is supposed to be December 2019 according to the information submitted to MahaRERA by the respondent. Therefore, the respondent was directed to mention the correct date as per the one while registering with MahaRERA. 19-09-2017: The respondent could not be present in person as he was arrested for the police investigation in relation to one of his other project and the Authority’s directions could not be complied with, informed the respondent’s representative. 29-09-2017: In this hearing, the representative of the respondent sought some more time to execute the registered Agreement as the respondent may be released on bail by 3-10-2017. Conclusion by MahaRERA Since the Agreement for Sale has been registered by both the parties now, it is the responsibility of respondent to deliver the project before the completion date mentioned to MahaRERA as December 2019. The correction of the date of possession shall be executed within one week from his release from police custody and the compliance report will be submitted to MahaRERA by the respondent. In view of the above directives, the complaint is disposed of. |
