The Complainant had booked an apartment in the respondent’s project. Due to his personal circumstances, he had to withdraw from the project. The respondent on humanitarian grounds returned a substantial percentage of the Booking amount.

The complainant has filed this complaint in order to obtain the complete booking amount.

The advocates of the respondent argued that according to the allotment letter, on withdrawing from the project the booking amount was to be forfeited entirely. But due to the complainant’s circumstances, the respondent returned an abundance of the booking amount.

According to the terms and conditions of the allotment letter, MahaRERA Authority cannot over rule the facts. Thus, the complainant is not liable to receive the full booking amount.

Hence, the complaint is disposed.
