Summary Case Summary The complainant had booked a flat in project ‘Universal Infra Developers’ under the agreement of sale dated on 27th November 2013. The complainant alleged that the respondent is agreed to give possession as On or before 30th October 2014, however, till date the possession has not yet been received. Further that, the respondent put a revised date of completion as 31st March 2018 on MahaRERA website and therefore, the complainant prayed for earlier possession and compensation. The respondent explained the reason for delay in possession. He also contended that he has applied for the Occupation certificate which is expected to be in 45 days and after that he is ready to give possession and moreover, the complainant paying the balanced consideration amount. Conclusion by MahaRERA Both complainant and respondent mutually agreed with the revised date of possession. Further, The authority ordered the respondent to handover the possession before the ending period of November 2017 otherwise, he have to pay interest on the entire amount that paid by the complainant from the date of 1st December 2017 till the of possession and interest rate would be at the rate of SBI that are prevailing at such time with two Percent. |
