 Case Summary 

The complainant has alleged that the respondent has failed to give possession of the said flat that he had booked in ‘Neptune Swarajya Sector 2-B14’ under the sale of agreement dated December 14, 2012, even after the 5 years since, they both signing the agreement.

Further, the respondent put a revised date of completion as on December 31, 2018 on MahaRERA website. But, the complainant doesn’t intend to continue the project.

After that the respondent explained the reasons that are beyond his control due to which the possession has got delayed. Then, both complainant and respondent mutually agreed for the fresh date of possession on 31st March 2018.

Conclusion by MahaRERA

In view of the above aforesaid fact, the respondent has directed to handover the possession till the ending of March 2018. If the respondent failed to give, he shall be liable to pay interest at the SBI rate of Marginal cost (that prevailing at such time) plus two percent, from April 2018 until he got the possession.

Hence, the matter is disposed off.
