MahaREAT Orders Demolition of Unauthorised Wing in Ambernath Housing Project
Dated on: Wednesday 9th September 2026The Maharashtra Real Estate Appellate Tribunal (MahaREAT) has ordered the demolition of an additional wing constructed at the Parshvadhara housing project in Ambernath, Thane. The tribunal found that the additional structure was introduced through a revised plan without obtaining the required prior informed consent of homebuyers. It held that a later planning approval could not override the rights and disclosures made to existing purchasers. The promoters were also directed to restore affected open spaces and amenities, execute conveyance of the project land and complete other pending obligations. A ₹10 lakh penalty was imposed for violations under RERA and MOFA.
