  • The provisions of the RERA Act, 2016 has given certain benefits and facilities to the promoters and the developers regarding the registration facilities of the projects of the promoter. Rules of various states of RERA has been described below regarding their withdrawal provision:

  • As per Rule 5 of Odisha Rules, 2017, in case the promoter applies for withdrawal of application for registration of the project before expiry of the period of 30 days, registration fee to the extent of ten percent paid shall be retained as processing fee.

The provisions of the RERA Act, 2016 has given certain benefits and facilities to the promoters and the developers regarding the registration facilities of the projects of the promoter. Rules of various states of RERA has been described below regarding their withdrawal provision:

Maharashtra
As per Rule 7 of the MAHARERA Rules, 2017, the promoter may apply for withdrawal of application for registration of the real estate project before the expiry of the period of 30 days of its submission to Authority. In such cases, the specific registration fee shall be retained as administrative charges towards the processing of the application by the Authority and the remaining amount shall be refunded to the promoter.

Gujarat
As per Rule 5 of GUJRERA Rules, 2017, in case the promoter applies for withdrawal of application for registration of the project before the expiry of the period of 30 days provided under sub- registration fee to the extent of 10% paid, or Rs. 50,000 whichever is more, shall be retained as a processing fee by the regulatory authority and the remaining amount shall be refunded to the promoter within 30 days from the date of such withdrawal.

Karnataka
As per Rule 5 of KRERA Rules, 2017, in case the promoter applies for withdrawal of application for registration of the project before the expiry of the period of 30 days, registration fee to the extent of ten percent paid or Rs. 50,000 whichever is more, shall be retained as a processing fee by the regulatory authority and the remaining amount shall be refunded to the promoter within 30 days from the date of such withdrawal.

Tamil Nadu
As per Rule 5 of TNERA Rules, 2017, in case the promoter applies for withdrawal of application for registration of the project before the expiry of the period of 30 days, registration fee as shall be retained as processing fee by the Authority and the remaining amount shall be refunded to the promoter within 30 days from the date of such withdrawal.

Odisha
As per Rule 5 of Odisha Rules, 2017, in case the promoter applies for withdrawal of application for registration of the project before expiry of the period of 30 days, registration fee to the extent of ten percent paid shall be retained as processing fee and the remaining amount shall be refunded to the promoter within 30 days from the date of such withdrawal.
 

Rajasthan
As per Rule 5 of Rajasthan Rules, 2017, in case the promoter applies for withdrawal of application for registration of the project before the expiry of the period of 30 days, registration fee to the extent of 5% paid or Rs. 25000 whichever is more, shall be retained as a processing fee by the Authority and the remaining amount shall be refunded to the promoter within 30 days from the date of such withdrawal.

Madhya Pradesh
As per Rule 5 of Madhya Pradesh Rules, 2017, in case the promoter applies for withdrawal of application for registration of the project after it has begun to be processed, but prior to a final decision being taken on it, or in case an application for registration is rejected, 10% of the registration application fee shall be retained as processing fees and the remaining amount shall be refunded to the promoter within 30 days from the date of such withdrawal or rejection, as the case maybe.
