Haryana RERA Upholds Fully Paid Buyer’s Right to Transfer Property
Dated on: Wednesday 30th September 2026Haryana RERA has upheld the right of a fully paid property buyer to transfer or sell the property, even when the promoter delays execution of the conveyance deed. The case involved a commercial shop in Sector 37C, Gurugram, where the buyer had paid over ₹27 lakh and taken possession. The authority held that a promoter’s delay in completing conveyance formalities cannot effectively prevent an owner from transferring the property. HRERA also directed the developer to pay 11% annual interest on ₹27.05 lakh, along with ₹1 lakh for mental harassment and ₹50,000 towards litigation expenses.
