MahaREAT Directs Mumbai Developer to Pay 2% Penalty, Share Commercial Sale Proceeds

The Maharashtra Real Estate Appellate Tribunal (MahaREAT) has directed the promoters of RA Residences in Dadar East, Mumbai, to pay a penalty equivalent to 2% of the project cost. The tribunal also ordered execution of a conveyance deed in favour of the housing society for the residential building, common areas and amenities based on the 2017 sanctioned plan. Sale proceeds from commercial units developed using additional FSI/TDR beyond the original plan must be apportioned among eligible allottees. The promoters were further directed to hand over 64 remaining guest-parking spaces. MahaREAT stressed that substantial changes to an approved plan require prior informed consent from allottees
