UP RERA Issues Refund Guidelines for Excess GST Charged to Homebuyers

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has introduced detailed guidelines to help homebuyers recover GST charged in excess by developers. Builders have been directed to collect GST strictly at government-prescribed rates. If a project is cancelled and the period for issuing a GST credit note has expired, eligible buyers can apply directly to the State Tax Department for a refund through the online mechanism. Refund claims must generally be filed within two years of cancellation, and claims below ₹1,000 are not eligible.
