- The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has issued a significant office order dated 05 January 2026, introducing a revised and mandatory Training & Certification framework for Real Estate Agents. This order replaces the earlier notification dated 10 October 2025 and aims to enhance professionalism, compliance, and transparency in the real estate sector.
This article explains the scope, applicability, training requirements, exemptions, fees, and compliance obligations under the new UP RERA regime.
Why Has UP RERA Introduced Mandatory Training?
Real estate agents play a critical role in connecting homebuyers and promoters. Recognizing their influence on consumer protection and sectoral growth, UP RERA has made structured training compulsory to ensure that agents:
- Understand the RERA Act, Rules, and Regulations
- Follow official guidelines and directions
- Act responsibly in buyer–seller transactions
- Contribute to a regulated and transparent real estate ecosystem
The training program is conducted under Regulation 54 of the UP RERA (General) Regulations, 2019 (7th Amendment).
Key Highlights of the Training Program
- Duration: 4 days
- Mode: Non-residential
- Examination: Conducted on the 4th day
- Certification: Issued only to candidates who pass the evaluation
- Training Venue: NIET, Greater Noida (with support from India Literacy Board, Lucknow and Kanpur University)
Only after obtaining the training certificate can an agent apply for new registration or amendment on the UP RERA portal.
Who Must Undergo Training?
(A) Individual / Proprietor Agents
1. Training is 100% mandatory
Applies to
- New registration
- Existing agents
- Registration amendments
(B) Partnership Firms, LLPs, Companies & Societies
UP RERA has introduced a phased training requirement for organizations.
(a) Partners / Directors
For agent registration or amendment:
1. Minimum training requirement:
(i) 50% of total partners/directors OR 2 partners/directors (Operations In-charge), whichever is less
2. These identified individuals must:
(i) Complete training
(ii) Pass the examination
(iii) Obtain certificates
Operational partners/directors must be trained first, while remaining partners must be trained later.
(b) Sales & Marketing Staff
All employees involved in:
- Sale of units or plots
- Buyer interaction or deal facilitation
must be considered.
- At least 25% of such staff (rounded to nearest whole number) must undergo training initially.
- Remaining staff must be trained in subsequent phases.
Rule for Foreign, NRI & Sleeping Directors
UP RERA provides a clear exemption for certain categories of partners/directors:
Exempted from Mandatory Training:
- Foreign nationals
- Non-Resident Indians (NRIs)
- Sleeping / non-operational partners or directors
Condition:
They must not be involved in operational or real estate agent activities as defined under Section 2(m) of the RERA Act, 2016.
Mandatory Documentation for Exemption:
- Self-attested copies of:
(i) Partnership Deed / MOA & AOA / Incorporation Certificate (as applicable)
2. A notarized affidavit confirming their non-operational status
3. Documents must be uploaded during online training profiling
Such exempted persons are not counted for calculating the 50% or 2-director requirement.
Affidavit Requirement for Remaining Members
After completing the initial mandatory training:
- The authorized signatory of the firm must upload a notarized affidavit on the UP RERA portal confirming that:
(i) Remaining partners, directors, officers, and staff will compulsorily undergo training in due course
Without this affidavit, the agent registration application will not be processed.
Training Fees & Re-attempt Rules
- Training fee: ₹6,000 per participant
- Applicants who earlier paid ₹5,000 must pay an additional ₹1,000
Failure & Absence Rules:
- One additional training opportunity is allowed
- Fee forfeiture applies if rules are not followed
- Candidates failing the exam may reappear by paying ₹3,000
Certificate Issuance & Validity
- Certificates must be collected in person from the UP RERA Headquarters in formal attire
- Certificates issued in a representative capacity:
(i) Remain valid even if the individual changes organizations
(ii) Can also be used for future individual registration
Deadline for Existing Agents
All agents registered prior to this order must complete training and obtain certification by 31 December 2026. Non-compliance may affect registration validity and future amendments.
Conclusion
The UP RERA Training & Certification Order of 2026 marks a decisive step toward professionalizing real estate agency operations in Uttar Pradesh. By mandating structured learning, phased compliance, and accountability through affidavits, the Authority has strengthened consumer protection and regulatory discipline.
