Registration of complaints on U.P. RERA web portal

In order to protect the interests of the homebuyers, the Authority allows them to ?le complaints against the promoters of un-registered projects also.
Section 12, 14, 18, and 19 of the RERA Act allow an aggrieved party to ?le a complaint about compensation with the adjudicating of?cer appointed by the Authority for matters related to compensation.
1. Complaints by the allottees of the registered projects
Section 31 of the RERA Act allows an aggrieved party, viz. homebuyer, real estate promoter, and real estate agent to file a complaint with the Authority against the other party for any violation or contravention of the provisions of this Act or the rules and regulations made thereunder. U.P. RERA provides an online module for filing of complaints with the Authority commonly known as e-courts. The aggrieved party needs to first register itself on the web portal, fill the required details and pay the requisite fee before submitting the complaint.
2. Complaints against un-registered projects
In order to protect the interests of the homebuyers, the Authority allows them to file complaints against the promoters of un-registered projects also. The homebuyer needs to submit the details of such an un-registered promoter and project while filing the complaint. Based on the information provided, the Authority scrutinizes the information to ascertain whether the project can be registered with U.P. RERA by seeking inputs from the concerned competent authority. Once the report is received from the technical division of U.P. RERA, the complaint is listed for hearing before the presiding officer.
3.Complaints about Compensation
Section 12, 14, 18, and 19 of the RERA Act allow an aggrieved party to file a complaint about compensation with the adjudicating officer appointed by the Authority for matters related to compensation. U.P. RERA has enabled the submission of such complaints via a separate Form N as prescribed by the U.P. RERA Rules. The procedure to file a complaint about compensation to the adjudicating officer is the same as the one for a complaint with the Authority in form M. For compensation-related complaints, the complainant has to select the applicable grounds, as per relevant section of the Act, under which compensation is being sought.
4. Conciliation Forum
Section 32(g) of the RERA Act promotes conciliation as a means to resolve disputes between the promoters and the homebuyers through amicable settlement. In accordance with the Act, U.P. RERA has established conciliation forums at Lucknow and Greater Noida under the guidance of experienced conciliators. Any grievant can raise a request for conciliation on the web portal using the form available under ‘Conciliation Forum’ section of the home page.
5. Order Execution
Ensuring compliance with the orders passed by the Authority is a difficult and challenging task. In order to facilitate the execution of its orders, the Authority has developed an order execution tracking module with details on the status of the order and the execution process.In case an order of the Authority is not complied with, the complainant can raise a request for executing the same with U.P. RERA using the ‘Request for Order Execution’ link on the homepage. The complainant, at any given time, shall be able to view the real-time status of the execution request on the web portal.
