Odisha Tribunal Declares Builder's Flat Allotment Cancellation Illegal, Strengthens Homebuyer Rights

The Odisha Real Estate Appellate Tribunal (OREAT) has ruled that a builder's unilateral cancellation of a flat allotment was illegal, providing significant relief to the homebuyer. The tribunal observed that the developer had accepted substantial payments and had also granted additional time for payment, making the subsequent cancellation unjustified. OREAT directed the builder to issue a revised demand by calculating delayed interest only for the legally applicable period and allowed the buyer one month to complete the payment. The ruling reinforces the principles of fairness, transparency, and protection of homebuyers under the Real Estate (Regulation and Development) Act (RERA)
